Thanks for using P-Cog. By using our Services, you're agreeing to our terms. We've tried to make them as concise as possible.

Using our Services

We provide a computer based application called the P-Cog. The P-Cog asks for patient demographic information, then gives an interactive test, followed by an expert system to help diagnose, workup, and treat cognitive disorders. This generates a report which is sent electronically to your office to be entered into a medical record. It has been validated for normal cognition, mild cognitive impairment, and dementia. By using the service, you must follow any policies made available to you within the service.

Don’t misuse our service! For example, don't enter HIPAA non-compliant information and email it to a subject's ex-husband. That would be stupid of you. Don't enter false information. Don't bill inappropriately (the test has not been validated in a 20 year old complaining of a migraine fog). Please only use the P-Cog in proper clinical contexts.

Our Service is available on mobile devices. Always obey traffic and safety laws. Obviously.

Protecting Information

To protect your patients, keep their information confidential! You don't want to get into trouble from the HIPAA police. You are solely responsible for the activity that happens on or through your use of the P-Cog. Don't send identifying information to people who should not have access to your patient's medical records. Do not send the P-Cog report to anyone other than your designated office staff involved in the care of your patient. HIPAA compliance requirements may vary. If in doubt, ask your compliance team. Our understanding is that even with a draconian reading of HIPPA compliance, you can send P-Cog reports (first name, last initial, DOB and tests results) via unencrypted email. This might not cut it with some institutions, so we recommend you ask the patient or Legally Authorized Representative for permission to share records via email with other medical care providers. This authorization should be in writing - give the patient or the authorized representative a form to fill out.

Privacy Protection

We do not store any personal data whatsoever. We protect both your privacy and that of your patient when you use our service. There is no storage of the scores, demographic information, or your selections.

Your Content in our Service

You enter data into the P-Cog. You then upload, submit, store, and send content. You retain ownership over all of it. Thus, you are responsible for behaving in a HIPAA compliant manner. If you submit feedback or suggestions about our service, we may use your feedback or suggestions without obligation to you. We thank you though in advance for your feedback.

About Software in our Service

You may not copy, modify, distribute, sell, or lease to others any part of our service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless you have our written permission. We may change and improve our service. You can stop using our service at any time, but please don't.

About Billing for our Service

You, as a clinician or health care administrator should consult with your office’s or institution’s coding and billing staff to determine the combination of codes that are the best fit. We have no say in how you bill, we aren't liable for how you bill, and we make no specific claims or promises in your relationship with health plans you participate in. Please feel free to call them and inquire about their payment for computerized cognitive testing. Our agreement with you is for the P-Cog service, not for how you bill. You might face denials with health plans. Please ask your coders and billers what codes you should use in what clinical settings. You agree not to sue us because you face denials or any other reason. The P-Cog does NOT instruct medical providers or admins or any user how to bill for healthcare procedures. New technologies may fall outside of Medicare national guidelines. You may require a determination of medical necessity or pre-certification. We can't speak to this. In all cases, users (providers, doctors, administrators) should first consult with appropriate payers, not restricted to Medicare, private insurances, intermediaries and others, for specific information on how to code, bill, and garner payments properly. There exists no promise or guarantee for coverage, coding, billing, and payment. We specifically reject liability or responsibility for the results or consequences of any monetary action. In short, once you buy the P-Cog or its use, your billing is between you and the payers, not you and us. We wish you best luck.

Our Warranties and Disclaimers

We provide the P-Cog and hope that you will find it useful. But there are certain things that we don’t promise about our service.

OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, WE DO NOT MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICE. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS.”

If your wifi is down, the app won't work. We can't guarantee things that we have no control over. We can't guarantee proper billing.

Liability for our Services

WHEN PERMITTED BY LAW, WE WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. IN ALL CASES, WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE..

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify P-Cog, any of its creators, authors, owners, or affiliated companies from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
